Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of embershieldhomehardening.com (the “Site”) and your purchase of products from Embershield Shop, operated by Embershield Home Hardening (“Embershield,” “we,” “us,” or “our”).
By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase products through it.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through the Site.
If you use the Site on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2. Online Product Sales and Installation Services
Embershield Shop sells home-hardening, ember-resistant, fire-resistant, and related building products for customer or contractor installation.
Unless expressly included in a separate written agreement, an online product purchase does not include:
Installation or construction labor
A wildfire-risk or home-hardening inspection
Engineering or architectural services
Permit preparation or acquisition
Building-code analysis
Job-site supervision
A home-improvement contract
A guarantee that a product is suitable for a particular property
Any inspection, construction, installation, or other professional service provided by Embershield Home Hardening will be governed by a separate written proposal or agreement.
3. Product Information
We attempt to provide accurate product descriptions, dimensions, specifications, photographs, pricing, compatibility information, and availability. However, product colors and appearances may vary by screen, lighting, production run, or manufacturer.
Manufacturers may modify product specifications, packaging, materials, or instructions without notice. Customers should review the manufacturer’s current specifications and installation instructions before purchasing or installing a product.
If you need help determining whether a product may be appropriate for your project, contact us before ordering. General information provided through the Site or by our staff is not a substitute for an on-site inspection, engineering advice, code review, or advice from a qualified installation professional.
4. Orders and Acceptance
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not necessarily mean the order has been accepted.
We reserve the right to decline, limit, or cancel an order for reasons including:
Product unavailability
Pricing or description errors
Suspected fraud or unauthorized payment
Shipping restrictions
Unusual purchasing activity
Quantity limitations
Inability to verify customer information
Orders placed for prohibited or unlawful purposes
If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.
5. Prices and Payment
Prices are displayed in U.S. dollars unless otherwise stated. Prices may change without notice, but changes will not affect an order already accepted.
Applicable sales tax, shipping charges, delivery fees, and other charges will be displayed during checkout when reasonably determinable.
You represent that:
The payment information you provide is accurate and complete
You are authorized to use the selected payment method
You will pay all charges associated with your order
Your billing and shipping information is current and accurate
Payment processing may be performed by a third-party provider subject to its own terms and privacy practices.
6. Shipping and Delivery
Shipping and delivery dates are estimates unless we expressly state otherwise. Delivery may be affected by product availability, manufacturer delays, carrier operations, weather, natural disasters, road conditions, address errors, and other circumstances outside our reasonable control.
If an order cannot be shipped within the promised period, we will provide any notice, cancellation opportunity, or refund required by applicable law.
You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect address, refused delivery, missed delivery, or requested redelivery may be charged to you where permitted by law.
Inspect shipments promptly after delivery. Report missing, incorrect, or visibly damaged products to us as soon as reasonably possible and retain the product, packaging, photographs, shipping label, and delivery documentation while the matter is reviewed.
7. Returns, Exchanges, and Refunds
Returns, exchanges, cancellations, and refunds are governed by the Return and Refund Policy posted on the Site and any product-specific restrictions disclosed before purchase.
Some products may be nonreturnable or subject to special conditions, including:
Custom-made or special-order products
Cut, altered, mixed, tinted, or installed materials
Clearance or final-sale merchandise
Products damaged through improper storage, handling, or installation
Hazardous materials or products subject to shipping restrictions
Opened products that cannot be safely resold
Nothing in these Terms limits any nonwaivable rights available under applicable consumer-protection law.
8. DIY Installation and Customer Responsibility
Many products offered through the Site are intended for do-it-yourself or professional installation. You are responsible for determining whether you have the knowledge, tools, physical ability, protective equipment, and site conditions necessary to perform the work safely.
Before beginning installation, you agree to:
Read and follow all current manufacturer instructions and warnings
Confirm product compatibility with the intended structure and application
Follow applicable building, fire, zoning, environmental, and safety codes
Determine whether permits, inspections, engineering, or approvals are required
Follow homeowners’ association and property restrictions
Use appropriate personal protective equipment
Engage a qualified or licensed professional when the work exceeds your abilities or when required by law
Roofing, structural, electrical, gas, mechanical, ladder, chemical, and elevated work can create serious risks. Stop work and consult a qualified professional if conditions are unsafe or instructions are unclear.
Embershield is not responsible for damage, injury, code violations, failed inspections, reduced product performance, or other losses caused by improper selection, storage, alteration, handling, or installation.
9. Wildfire and Fire-Protection Disclaimer
Home-hardening and fire-resistant products are intended to reduce certain vulnerabilities. No product, material, assembly, treatment, or installation can eliminate every risk presented by wildfire, structure fire, wind-driven embers, radiant heat, direct flame contact, smoke, or extreme weather.
Unless expressly stated in a separate written warranty, Embershield does not guarantee that a product will:
Make a structure fireproof or ember-proof
Prevent ignition, injury, death, or property loss
Cause a home to survive a wildfire
Satisfy every building or fire code
Qualify a property for insurance coverage or discounts
Prevent an insurer from canceling, limiting, or increasing the cost of coverage
Satisfy an inspection, appraisal, disclosure, or governmental requirement
Product performance depends on numerous factors, including design, installation quality, maintenance, surrounding vegetation, weather, fire intensity, building condition, and the performance of other building components.
10. Manufacturer Instructions and Warranties
Products may be covered by warranties provided by their manufacturers. Warranty availability, duration, exclusions, registration requirements, and remedies vary by product.
You are responsible for reviewing and following the manufacturer’s warranty requirements, including installation, maintenance, documentation, and registration requirements.
Except for warranties expressly provided by Embershield in writing, manufacturer warranties are provided by the manufacturer and not by Embershield. We may assist with a warranty inquiry but cannot guarantee a manufacturer’s decision or remedy.
11. Site Content
Articles, guides, videos, product comparisons, checklists, recommendations, and other Site content are provided for general educational purposes.
Site content is not engineering, architectural, legal, insurance, fire-science, or building-code advice. Codes and requirements vary by location and may change. Consult the appropriate professional or governmental authority for advice concerning your property.
12. Acceptable Use
You may not:
Use the Site for unlawful, fraudulent, or harmful purposes
Attempt to gain unauthorized access to the Site or another user’s account
Introduce malware or interfere with Site security or operation
Scrape, copy, or harvest Site content or customer information without authorization
Impersonate another person or provide false information
Use our products in violation of law or manufacturer instructions
Resell products in a misleading manner or remove safety information
Infringe our intellectual property or the rights of others
We may suspend or terminate access when we reasonably believe these Terms have been violated.
13. Intellectual Property
The Site and its text, graphics, photographs, logos, videos, designs, downloads, and other original content are owned by or licensed to Embershield and are protected by applicable intellectual-property laws.
You may use Site content for personal, noncommercial purposes associated with evaluating or using our products. No other copying, modification, publication, distribution, sale, or commercial exploitation is permitted without prior written authorization.
Product names, manufacturer trademarks, and third-party content remain the property of their respective owners.
14. Reviews and Submitted Content
If you submit a review, photograph, comment, testimonial, or other content, you represent that:
You created it or have permission to submit it
It is accurate and reflects your genuine experience
It does not violate another person’s rights
It does not contain unlawful, defamatory, deceptive, or harmful material
You grant Embershield a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute the submitted content for operating and promoting our business, subject to applicable law.
We may moderate or remove submitted content but are not obligated to publish every submission.
15. Third-Party Services and Links
The Site may contain links to manufacturers, payment processors, shipping companies, financing providers, social-media platforms, or other third parties.
We are not responsible for third-party websites, content, security, availability, products, or privacy practices. Your interaction with a third party is governed by that party’s terms and policies.
16. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED IN WRITING OR RIGHTS THAT CANNOT LEGALLY BE WAIVED, EMBERSHIELD DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Some jurisdictions do not permit certain warranty limitations, so portions of this section may not apply to you.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EMBERSHIELD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF USE, OR BUSINESS INTERRUPTION.
TO THE EXTENT PERMITTED BY LAW, EMBERSHIELD’S TOTAL LIABILITY ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO EMBERSHIELD FOR THE PRODUCT GIVING RISE TO THE CLAIM.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or certain personal injuries.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Embershield and its owners, employees, contractors, and service providers from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Site, violation of these Terms, misuse of a product, or infringement of another party’s rights.
19. Privacy
Our collection and use of personal information are described in our Privacy Policy and Cookie Policy. Those policies are incorporated into these Terms by reference.
20. Changes to These Terms
We may update these Terms to reflect changes in our products, services, technology, or legal obligations. Updated Terms will be posted with a revised effective date.
Changes apply prospectively and will not retroactively alter an accepted order unless required by law or agreed to by the customer.
21. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes arising from these Terms or the Site will be brought in the state or federal courts serving El Dorado County, California. You and Embershield consent to the jurisdiction of those courts.
22. General Provisions
If any portion of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of that provision. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a merger, reorganization, sale, or transfer of our business or assets.
These Terms, together with the policies and disclosures referenced here, constitute the agreement governing your use of the Site and online product purchases.
